You must at all times comply with the FSM Telecommunications Act 2014. In addition, the TRA is required under the Act to make rules advancing the objectives of the Act. The TRA promogulated a set of rules in 2019 which apply to the telecommunications market. These rules are:
- the Telecommunications Operating License Rules for operators of communication networks or services;
- the Telecommunications Spectrum License Rules for spectrum licenses which relate to the use of radio frequency spectrum for the provision of communication services and are designed to ensure that these limited resources are efficiently allocated to persons who will use them;
- the Telecommunications Interconnection & Access Rules which are designed to encourage competition by enabling fair access to, or use of, infrastructure networks by any operator who wishes to provide customers with telecommunications services and to advance customers interests by ensuring that all customers can communicate with each other or connect to all the services they demand regardless of which operator provides as service;
- the Telecommunications Schedule of Fees which outlines the fees payable for the application, renewal and annual costs (if relevant) for each type of license that we may grant; and
- the FSM National Numbering Plan which, among other matters, sets out the terms on which telephone numbers will be allocated.
